This Privacy Policy (the “Policy”) describes how YAMAMOTORS RIDERS S.R.L. (“Momentum”, the “Controller”, “we”) collects, uses, discloses and protects the personal data of individuals who visit momentumfitness.eu, submit quote requests, communicate with us or enter into contracts with us (“you”, the “data subject”).
We process personal data in accordance with Regulation (EU) 2016/679 (“GDPR”), Romanian Law no. 190/2018 implementing the GDPR, Law no. 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector, and other applicable legal provisions.
Data Protection Officer (DPO): The Controller is not legally required to appoint a Data Protection Officer under Art. 37 GDPR, as its core activity does not consist of large-scale systematic monitoring or large-scale processing of special categories of data. For any personal-data matter, contact us at office@momentumfitness.eu.
We do not intentionally request or process special categories of data (health data, biometric data, etc.). Please do not send us such data through our forms or communication channels.

Providing identification and contact data is necessary to respond to your requests and to conclude and perform the contract. Refusal to provide such data may make it impossible to process a quote request, conclude the contract or provide services. Providing data for marketing purposes is voluntary and based on consent, which you may withdraw at any time.
We do not sell or trade your personal data.
Some of our providers (in particular Google and Meta) may process data outside the European Economic Area, including in the United States. Such transfers rely on appropriate safeguards under Art. 46 GDPR, namely the Standard Contractual Clauses adopted by the European Commission and/or the EU–U.S. Data Privacy Framework, where the provider is certified. A copy of the applicable safeguards is available upon request at office@momentumfitness.eu.

You may exercise your rights by written request to office@momentumfitness.eu or at our registered office. We will respond within one month of receipt, extendable by two months for complex requests, with notice to you.

We have implemented appropriate technical and organisational measures to protect data against unauthorised access, loss, destruction or disclosure, including access control, encrypted connections (HTTPS/SSL), internal confidentiality policies and data-processing agreements with our processors.
Our website and services are intended for professionals and persons over 18 and are not directed at minors. Under Art. 8 GDPR and Law no. 190/2018, we do not knowingly process data of children under 16 without the consent of the holder of parental responsibility.
