Please read this document carefully before using momentumfitness.eu (the “Site”) and before submitting a quote request or order. Using the Site and submitting a request constitutes acceptance of these Terms & Conditions (the “Terms”).
The Site is a catalogue and quote-request platform. It has no online ordering or payment module. Prices shown are estimated, indicative B2B values in EUR and do not constitute a firm offer in the legal sense, but an invitation to request an offer. The final price, delivery terms, discounts, transport, installation and financing options are set individually through the Seller’s written offer (quotation/proforma).
The Seller may refuse a request or decline an order for justified reasons (unavailability, obvious price errors, impossibility of delivery, fraud suspicion), notifying the Client and refunding any amounts received.
Offer prices are in EUR and clearly state whether VAT and other taxes, transport and installation are included. Payment is made, per the offer, by bank transfer to the account on the invoice or via financing/leasing solutions through the Seller’s partners. Ownership of the Products passes to the Client upon full payment, unless otherwise stated in the offer/contract.
The Seller provides delivery, insured transport, professional on-site “white-glove” installation and training per the offer. Delivery times are as stated in the offer and are estimates, subject to CTN.FI manufacturer availability and international logistics. Risk of loss or damage passes to the Client upon delivery, except where the law mandatorily provides otherwise in favour of the Consumer (Art. 20 GEO no. 34/2014, transport arranged by the Seller).
Where the Client is a Consumer and the contract is concluded at a distance or off-premises, the Consumer has a 14-day statutory right of withdrawal, without giving reasons, under GEO no. 34/2014. The exercise, statutory exceptions (including made-to-order/configured Products) and consequences are detailed in the Return Policy, an integral part of these Terms. The Consumer also benefits from the 2-year legal guarantee of conformity under GEO no. 140/2021.
Note for professional (B2B) clients: the 14-day statutory withdrawal right does not apply between professionals. B2B returns and warranty are governed by the commercial contract, the manufacturer’s commercial warranty and the Civil Code provisions on defects.
The Products are professional equipment for commercial/clinical environments operated by qualified staff. The Client must follow installation, use, maintenance and safety instructions and applicable local regulations (including any required health/medical authorisations). The Seller is not liable for non-compliant use or the Client’s failure to obtain authorisations.
No medical claims: Site information is commercial and technical and does not constitute medical advice, diagnosis or guarantees of therapeutic results. Any health-related use is under the responsibility of the Client’s qualified professionals.
All Site content (text, images, graphics, logos, trademarks, structure) belongs to the Seller or its partners (including the CTN.FI brand, used as official distributor) and is protected by IP law. Reproduction, distribution or use without prior written consent is prohibited.
To the extent permitted by law, the Seller is not liable for indirect damage, loss of profit or opportunity arising from use of the Site or Products, except for wilful misconduct or gross negligence and without limiting the Consumer’s mandatory rights. The Seller uses reasonable efforts for accuracy but does not warrant the absence of description or price errors, which may be corrected.
Neither party is liable for non-performance caused by force majeure or fortuitous event, under the Civil Code.
Complaints may be sent to office@momentumfitness.eu or to the registered office. Consumers may also contact the National Authority for Consumer Protection (ANPC), anpc.ro, and may use Alternative Dispute Resolution (SAL) under GO no. 38/2015 via the ANPC ADR Directorate.
Legal update: the EU Online Dispute Resolution (ODR) platform was permanently shut down on 20 July 2025 (Regulation (EU) 2024/3228); there is no longer any obligation or possibility to reference it.
These Terms are governed by Romanian law. Disputes are first sought to be settled amicably; failing that, the Romanian courts have jurisdiction. For Consumers, jurisdiction follows mandatory consumer-protection rules (including, where applicable, the Consumer’s domicile). For B2B relations, the courts at the Seller’s registered office have jurisdiction unless otherwise agreed.
By subscribing to the newsletter or giving consent, the Client accepts commercial communications under Law no. 365/2002 and Law no. 506/2004. Unsubscribing is possible at any time, free of charge, via the link in each message or at office@momentumfitness.eu.
If a clause is void or unenforceable, the remaining clauses stay valid. The Seller may amend these Terms; the applicable version is the one published on the Site at the time of the request/order. These Terms are supplemented by the Privacy Policy, Cookie Policy and Return Policy.
